These Terms of Service ("Terms") form an agreement between you and Nexgenz Technologies ("Nexgenz", "we", "us") covering our domains, hosting, design, development and related services. By ordering or using our services you agree to these Terms.
1. Services
We provide domain registration, web hosting, website and application development, and related IT services as described on our website and in any order or quotation you accept. Specific products may carry their own specifications and fair-use limits.
2. Accounts
You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You must notify us promptly of any unauthorised use of your account.
3. Orders, pricing & billing
Prices are shown in USD and are due in advance for the billing period selected. Recurring services renew automatically unless cancelled before the renewal date. You are responsible for applicable taxes. We may update pricing with notice; changes do not affect the current paid term.
4. Refunds
Refunds are governed by our Refund Policy. Domain registrations and third-party fees are generally non-refundable.
5. Acceptable use
You may not use our services to host or transmit unlawful, infringing, malicious or abusive content, to send spam, or to compromise the security or performance of our infrastructure or others'. We may suspend services that violate this clause.
6. Domains
Domain registrations are subject to the policies of the relevant registry and ICANN, and to our upstream registrar's terms. Renewal, transfer and recovery are subject to those rules and timelines.
7. Hosting & uptime
We target 99.9% uptime and maintain backups, but you remain responsible for your own content and for keeping independent copies of critical data.
8. Intellectual property
On full payment for custom work, ownership of the final deliverables transfers to you, except for third-party components and our pre-existing tools, which are licensed to you for use in the delivered work.
9. Disclaimers & liability
Services are provided "as is" to the extent permitted by law. Our total liability for any claim is limited to the amount you paid for the affected service in the preceding three months. We are not liable for indirect or consequential losses.
10. Termination
Either party may terminate for material breach that is not remedied within a reasonable notice period. Non-payment may result in suspension or termination.
11. Governing law
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles.
